TradeAcademy Terms and Conditions (Apprenticeship Programmes)

1. Introduction

These Terms and Conditions outline the responsibilities and expectations of the Training Academy, the employer, and the apprentice during the delivery of apprenticeship programmes. By enrolling in or sponsoring an apprenticeship, all parties agree to these terms.

2. Parties Involved

  • Training Provider: Trade Academy
  • Employer: The organisation employing the apprentice
  • Apprentice: The individual undertaking the apprenticeship programme

3. Programme Delivery

  • The Trade Academy will deliver the apprenticeship programme as approved by
    relevant awarding bodies and in line with ESFA (Education and Skills Funding
    Agency) requirements.
  • Training will include on-programme learning, functional skills (if applicable), and
  • End-Point Assessment preparation.
  • Delivery may be through blended learning, in-person training, online platforms, or workplace visits.

4. Roles and Responsibilities

a) Training Provider:
  • Deliver high-quality training and assessment
  • Maintain regular progress reviews
  • Provide support, feedback, and safeguarding information
  • Maintain compliance with data protection and funding regulations
b) Employer:
  • Provide a suitable working environment and support apprentice development
  • Release the apprentice for off-the-job training as per funding rules (minimum 20%)
  • Participate in regular progress reviews
  • Ensure the apprentice is paid at least the minimum apprenticeship wage
c) Apprentice:
  • Attend scheduled training sessions and complete required assignments
  • Adhere to academy and employer policies (including behaviour, attendance, and
    academic integrity)
  • Engage actively with both on-the-job and off-the-job learning

5. Attendance and Conduct

  • Consistent attendance is expected. Absences must be reported promptly.
  • Poor attendance or misconduct may result in disciplinary action or withdrawal from
    the programme.

6. Funding and Fees

  • Apprenticeship training may be government-funded or part-funded based on
    eligibility.
  • Employers may be required to contribute 5% of the training costs (co-investment).
  • Additional costs may apply for resits, replacement certificates, or optional extras.

7. Safeguarding and Wellbeing

  • The Trade Academy has a duty to safeguard all learners.
  • Any concerns will be managed in line with safeguarding policies and procedures.
  • Mental health and wellbeing support is available for all apprentices.

8. Data Protection

  • All personal information will be processed in accordance with UK GDPR and Data Protection Act 2018.
  • Data may be shared with funding bodies, awarding organisations, and Ofsted as required.

9. Changes to Programme or Contract

  • The Trade Academy reserves the right to make changes to programme delivery (e.g., due to government guidance or organisational needs).
  • Significant changes will be communicated in advance.

10. Termination and Withdrawal

  • Apprentices may withdraw voluntarily or be withdrawn due to inactivity, poor performance, or disciplinary issues.
  • Employers must inform the Trade Academy of any changes to employment or eligibility.

11. Complaints and Appeals

  • Complaints should be raised in accordance with the Trade Academy’s Complaints Policy.
  • Apprentices and employers may appeal assessment decisions via the formal appeals process.

12. Agreement

By proceeding with the apprenticeship, all parties confirm they have read, understood, and agree to abide by these Terms and Conditions.
